These Terms of Service ("Terms") govern your access to and use of the websites, dashboards, and services offered by BoostedEcho ("BoostedEcho," "we," "us," or "our"). By purchasing or using our services, you agree to these Terms.

1) What We Do

BoostedEcho provides promotional campaign services for music artists and creators, including curated placements, outreach, and campaign strategy (collectively, the "Services"). Deliverables are described on the checkout page and/or order confirmation. We may update specific deliverables to comparable alternatives when needed for quality or availability.

2) Your Responsibilities

Accurate inputs. You're responsible for providing correct links, assets, and instructions and confirming that you own or have permission to promote the content.
Compliance. You must comply with all applicable laws and the policies of any platforms where campaigns run (e.g., music/streaming/social platforms). We may pause or refuse campaigns that violate policies or law.
Account access. If you provide access tokens, links, or any credentials, you represent you're authorized to do so and accept any platform-level consequences of the content you submit.

3) Ordering, Pricing, and Billing

Checkout. Prices, taxes, and fees are shown at checkout. You authorize us (or our processor, e.g., Stripe) to charge your payment method.
Subscriptions (if offered). If you opt in to a recurring plan, you authorize recurring charges until you cancel in your dashboard or by contacting support before the next renewal.
Promotions. Coupons or discounts may have conditions and may be changed or discontinued at any time.

4) Start Window & Scheduling

We target a start window of 0–24 hours from payment confirmation ("Start Window"). The Start Window is a target, not a guarantee, and may be impacted by volume, platform availability, quality checks, or force majeure.

5) Estimates, Projections, and Results

We use historical performance and partner availability to provide good-faith forecasts. Internally, we target ≈95% accuracy on estimated reach/placements; however, estimates are not guarantees and real-world results vary due to factors outside our control (platform changes, audience behavior, content quality, timing, etc.).

If actual results materially deviate from the forecast, we will continue working in-scope and in good faith to close the gap where reasonably possible, or, at our discretion, issue a proportionate service credit. Credits are not cash refunds and may be applied to future campaigns.

6) Revisions, Pauses, and Replacements

We may, at our discretion, substitute equivalent placements or adjust tactics to maintain campaign quality. You may request a pause; we'll try to accommodate if operationally feasible, but pausing after launch may reduce effectiveness.

7) Refunds, Chargebacks, and Disputes

Refunds. Because campaigns begin planning immediately and start quickly, all sales are final once the order is queued, except where required by law.

Chargebacks. You agree to contact support@boostedecho.com first to resolve concerns.

8) Acceptable Use & Content Standards

No illegal, infringing, hateful, or deceptive content; no content that violates platform rules or third-party rights. We may reject or remove campaigns that present legal or reputational risk.

9) Ownership & License

You retain ownership of your content. You grant us a limited, revocable license to use, transmit, and display the content solely to perform the Services and to showcase anonymized campaign outcomes.

10) Third-Party Platforms & Dependencies

Our Services may rely on third-party platforms, tools, and partners. We do not control these parties and are not responsible for outages, policy changes, or removals.

11) No Professional Guarantees

Except as expressly stated, the Services are provided "AS IS" without warranties of merchantability, fitness for a particular purpose, or non-infringement.

12) Limitation of Liability

To the maximum extent permitted by law, BoostedEcho will not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages, lost profits, lost goodwill, or loss of data. Our total liability for any claim relating to the Services will not exceed the amount you paid to BoostedEcho for the order at issue in the three (3) months prior to the event giving rise to liability.

13) Indemnity

You agree to defend, indemnify, and hold harmless BoostedEcho and its personnel from any claims, damages, or expenses arising from (a) your content; (b) your breach of these Terms; or (c) your violation of law or third-party rights.

14) Confidentiality

Non-public campaign strategy and partner lists are BoostedEcho confidential information. You agree not to disclose or reverse-engineer our methods. We treat your non-public information as confidential except where disclosure is required by law or payment processors.

15) Suspension & Termination

We may suspend or terminate access for violations, suspected fraud/abuse, or risk concerns. You may terminate future use at any time. Sections that by nature should survive (e.g., payments due, confidentiality, IP, disclaimers, limitations, and dispute resolution) survive termination.

16) Governing Law; Arbitration; Class Waiver

These Terms are governed by the laws of the Commonwealth of Massachusetts, USA, without regard to conflicts principles. Any dispute arising out of or relating to the Terms or Services will be resolved by binding arbitration administered by JAMS in English, with a single arbitrator, in Boston, MA (or remote at the arbitrator's discretion). You and BoostedEcho waive any right to participate in a class or representative action.

17) Modifications

We may update these Terms by posting a revised version with a new "Last Updated" date. Changes apply prospectively. Material changes will be reasonably announced (e.g., on-site notice or email).

This Privacy Policy explains how BoostedEcho ("we," "us," "our") collects, uses, and shares information when you visit our sites, create an account, or purchase our Services.

1) Information We Collect

Information you provide: name, email, links to content, campaign instructions, billing address, and support messages.
Payment data: We use third-party processors (e.g., Stripe) to process payments; we do not store full card numbers. Limited payment metadata (e.g., last4, brand, transaction IDs) may be retained for records and dispute handling.
Technical data: IP address, device and browser info, approximate location, pages viewed, referring URLs, and timestamps (via cookies, pixels, or similar).
Campaign data: performance metrics, placements, and fulfillment notes.

2) How We Use Information

  • Provide, personalize, and operate the Services and dashboard
  • Verify purchases, process payments, and manage orders
  • Communicate with you about campaigns, updates, and support
  • Monitor quality, prevent fraud/abuse, and comply with legal obligations
  • Analyze aggregated performance to improve Services and forecasting

3) Cookies & Tracking

We use cookies and similar technologies for authentication, preferences, analytics, and fraud prevention. You can control cookies via your browser; disabling some cookies may limit functionality.

4) Sharing of Information

We share information with:

Service providers/processors (e.g., Stripe for payments, hosting, analytics, customer support) who process data under instructions and appropriate safeguards.
Partners strictly as needed to fulfill placements or measure performance.
Legal/compliance recipients when required by law, to protect rights, or to investigate abuse.
Business transfers in the event of a merger, acquisition, or asset sale.

We do not sell personal information for money. We may use aggregated or de-identified data for analytics, reporting, or marketing.

5) Data Retention

We retain personal data as necessary for the purposes described and to meet legal/accounting requirements. Retention periods vary by record type (e.g., orders and invoices are generally kept for at least 7 years).

6) Security

We use reasonable administrative, technical, and physical safeguards appropriate to the risk. No system is 100% secure. If we detect a security incident affecting your data, we will notify you as required by law.

7) Your Choices & Rights

Access/Update: Manage profile details in your dashboard or contact support.
Marketing: You can opt out of non-transactional emails via unsubscribe links.
Deletion: You may request deletion of your account; we may retain certain records as required by law.

8) Children's Data

Our Services are not directed to individuals under 13 (or the minimum age in your jurisdiction). We do not knowingly collect personal data from children.

9) International Transfers

We may process data in the United States or other countries. Where required, we rely on appropriate transfer mechanisms (e.g., standard contractual clauses).

10) Payment Processing & Disputes

Payments are processed by Stripe. In the event of a dispute, we may share necessary order and communication records with Stripe solely for resolution. Stripe's independent privacy practices apply to its processing.

11) Changes to This Policy

We may update this Privacy Policy; the "Last Updated" date will reflect changes. Material changes will be reasonably announced.
